第2期 郭道晖：人权的本性与价值位阶 有些论者常常讲：如果农民连饭都没有吃的，民主、自由对他有什么用8这种说法，一是以为农民 只要求满足动物般生存的需要就够了；二是无视农民生存权受到威胁，主要是由于他们的民主权利和经 济自由权受到压制。安徽省凤阳县的8户农民为免于饥饿，偷偷写下血书，带头实行包产到户，就是把 经济上的自由，作为首要权利来争取，其生存权才有了保障。改革开放以来，农民的温饱权有了基本保 障，这也是在农村首先破除了压制农民经济自由权利的种种束缚，使之享有某些经济上的自主与自由 (自由贸易与办乡镇企业)，才使农民逐步摆脱了贫困处境。我国改革开放新时期的到来，也首先是由于 打倒了“四人帮”和党的十一届三中全会实现了指导思想的拨乱反正，即争取和实现政治人权在先，才有 现今的经济发展和生存权得到维护。 可见，为了保障人民珊众的生存权，有赖于首先争得民主与自由等政治人权，从而取得经济人权。 民主自由本身固然不能当饭吃，但历史己经证明，没有民主自由就一定没有饭吃。 所以，我认为，政治人权仍应是我国现今的首要人权。 [参考文献] [1]赵汀阳.有偿人权和做人主义U].哲学研究，1996， 1993.
