目前我国民法典的起草工作正在紧锣密鼓地进行着，在民法典中如何确立民事习 惯的地位问题引人关注。通过对古今中外历史的考察，我们发现，清末至民国时期，我国曾 经展开过几次全国范围的、规模巨大的民商事习惯调查运动，为民商事立法工作留下了大量 的有关国情民俗方面的基础资料，并且，南京国民政府在起草民法典时明确将民事习惯视为 法源之一；大陆法系各主要国家的民法典都对民事习惯给予了高度的重视，相反，我国自建 国以来对民事习惯一直采取漠视或不重视的态度
