Section 1 Introduction ◼ 3.international customs国际惯例 ◼ ⑴《华沙—牛津规则》Warsaw-Oxford Rules ◼ 1928年国际法协会华沙会议编纂CIF方面的惯例,称为《华沙规 则》;后经该协会1932年牛津会议修订,改称《华沙--牛津规则》, 全文21条。它的“序言”指出,“本规则旨在向那些有意按CIF条件 进行货物买卖而目前缺乏可用的标准合同格式或共同条件的人们提供 办法,使他们在CIF合同中能自愿地且容易地采用一套统一规则。” 当事人签订合同,如全部或部分涉及海上运输的货物买卖,只要明示 采用《规则》,就构成了双方当事人有意使其合同成为CIF合同的确 定证据。当事人订立合同,也只有明示地同意采用《规则》,《规则》 对他们才有约束力。《华沙--牛津规则》制订迄今,已60多年,虽一 直得到国际上的承认,但现在一般采用的是ICC《国际贸易术语解释 通则》中的CIF规则
